British Airways sending legal letters to people requesting compensation for the data breach

A Head for Points reader sent me an interesting letter he had received after writing to British Airways to request compensation for the recent data breach.

Instead of responding directly, British Airways passed his complaint to DWF, a Manchester law firm.  He received a firm legal letter from an Andrew Harris at DWF which whilst totally correct in what it said was – to my mind – designed to scare the complainant off from pursuing any claim.

Since Harris is:

“Accomplished in significant shareholder disputes and other corporate litigation” (2011), –one of the best commercial litigators outside London” (2012) and –the standout choice for shareholder disputes” (2013).”

…. according to the “Legal 500”, it is likely that it will have cost British Airways £1,000 in legal fees to get Harris to write the fairly long letter sent to the reader telling him that he can’t have anything …..

    Most people that work in the Data Protection Industry are expecting BA to be writing a big cheque to the Treasury

    Flying Club Europe to Amsterdam from City Airport tonight (no economy availability) which I know is to all intents a pretty useless upgrade.

    Was just wondering if I’m likely even to get any food, on such a short flight? I’ve seen a lot of CityFlyer reviews saying the food is so good because it’s the only benefit, but are they really going to bother for a 1h5m flight?

      We got food in economy on a CityFlyer from MAN to Nice. They also do meal service in CE from MAN to LHR which is a 45 minute flight, so it’s definitely doable!

      Yes you’ll get a cold snack – quality is good, on a par with the new Do&Co catering from Heathrow. The CityFlyer crew can easily fit a meal and a couple of drinks rounds into a 1h 20 from EDI. They are up and at it as soon as seatbelt lights go off and come round with plastic cups at 10/15 mins to landing to finish drinks. It’s rather impressive.

      I was expecting the same re food (on luxair from city) – pleasantly surprised to get a nice sandwich, drinks and champagne!

      I did economy to Amsterdam couple of weeks ago from London city. Yes you do get food, what I don’t know in club, but in economy it was a choice of packet or crisps or packet of biscuits.

    OT: looking to book for Seoul next year in Club class for myself & my mum.
    Both my husband and I have a Lloyds upgrade voucher. Can I use these to book for myself & my mum or does my husband have to travel?

    O/T – I have a Kaligo prepaid rate for tonight which I now cannot attend due to a change of work circumstance. It’s a non refundable rate.

    Do Kaligo get any notification if you don’t check-in and how does this potentially affect the Avios due to be earnt for the booking?

      I had a situation when I booked three rooms but only two rooms were taken as one of my colleagues couldn’t travel. I still received the full bonus.

    I sure I am not the only one to have received a “reminder” from Iberia Plus with regards to the air miles promotionin the last few dayswhich included the following:

    “We would also like to take this opportunity to remind you that the programme does not include the transfer of Avios, as indicated in the general terms and conditions.”

    This seems to be at odds with the statement in the Daily Mail that transfers are allowed and I wonder if they are backtracking already.

        I’ve received it but it remains clear as mud. How can it be that transfers are not allowed, but are? If they somehow take the points from my BA account, I will be very annoyed, but also, what is ‘spending’? I’ve made and cancelled several redemptions lately – are those points ‘spent’? And of course, this resulted in my data being breached. Happy days…

      They never said they were allowed in the sense that doing a transfer would satisfy the requirement to spend them by December.

      They did relent and make it technically possible but nobody can pretend to be surprised or for that matter hard done by if they don’t let you take the Mickey here and anyone that decided to risk gaming the system winds up with a claw back..

        I’m supremely unconcerned if I end up with a ‘negative’ Iberia balance as promised, then un-promised, then re-promised. But I won’t be happy if they sneak the miles out of my BA account somehow.

          Yeah, well, JAL in business/first (if the latter exists) from Tokyo to Hawaii would be my choice redemption and I think I am tempted to make an emergency booking just before the deadline to see what happens.

          But you’d think, with so many eyes on this, that someone could reliably tell people, without absurd ambiguities, what is going on.

      I got the email and tried to reply to it. But their email rejected replies and they provided no contact details. I only wanted to reply to them reminding them that i ‘d already sent them a formal notice right after the promotion that I did not accept them trying to add any further terms and condititions to the terms based on which I purchased flights in the promotion. I’d love this to go to court. Iberia has been perhaps stupid but definitely sneaky and, I think, attempting to act illegally. It’s breach of contract – contract was made when I accepted their published terms and paid them money under those terms. Subsequently Iberia has been trying to amend those existing terms and I have sent them notice that I reject their attempt to change the terms and in particular to add restrictions.

      They deserve someone to sue them. If that happens however I expect them to follow the British Airways approach of settling to keep it out of court so a precedent won’ensure. et when they lose to open the door to widespread claims, but with a gag order so word doesn’t get around also triggering others to claim.

    I’ve moved the Iberia miles to my BA account. I am uncertain of a few things…
    1) Will the miles go poof or will I get to keep these?
    2) Will I need to have flown the flight already if I use the miles?
    3) Will I need to have just booked the flight.

    Help!

      1 – no going poof in BA a/c on Dec 2nd, you may lose them later if IB & BAEC join the same loyalty platform in future & you’re running a -90K balance in your IB a/c
      2 – no
      3 – yes

      But 2 & 3 refer to points held in IB a/c
