British Airways sending legal letters to people requesting compensation for the data breach

A Head for Points reader sent me an interesting letter he had received after writing to British Airways to request compensation for the recent data breach.

Instead of responding directly, British Airways passed his complaint to DWF, a Manchester law firm.  He received a firm legal letter from an Andrew Harris at DWF which whilst totally correct in what it said was – to my mind – designed to scare the complainant off from pursuing any claim.

Since Harris is:

“Accomplished in significant shareholder disputes and other corporate litigation” (2011), –one of the best commercial litigators outside London” (2012) and –the standout choice for shareholder disputes” (2013).”

…. according to the “Legal 500”, it is likely that it will have cost British Airways £1,000 in legal fees to get Harris to write the fairly long letter sent to the reader telling him that he can’t have anything …..

    OT:

    I want to book a cathay redemption but BA is showing no availability. I have an old Asia Miles account with barely any points and using it I can see that there is plenty of availability on Asia Miles.

    Is it possible for me to call BA and cite this Asia Miles availability and then redeem for Cathay seats using Avios?

      Check AA and Quantas and if you still see the availability try ringing BA and booking over the phone. There are reports on FT that BA can book CX redemptions over the phone.

      I learnt BA cuts all CX 1-2 weeks from the date despite redemption seat still being available. These can be booked via the phone.

    Another case for BA’s lawyers – and a lot more interesting, given that this is an increasing problem for the majority of reasonably fit passengers (as well as the NHS).

    Yes this will Ben interesting. Only received 81k miles instead of the 90k. After multiple emails never got any response from them for the other 9k despite all booked same time in same way.

    Initially booked a US hotel at slightly More than 81k (87k) but needed to cancel. After 5 days and 11 calls to Iberia in Spain they said they couldn’t cancel, however when I called avios.com instead they cancelled it there and then and refunded my avios immediately. So my account shows a redemption on iberia. Then decided to transfer to BA and booked two 1 way flights from LAX to SYD with Qantas in economy for 100k + £38 with the miles. Hoping they don’t come back to me on that.

      At LHR I think it’s 11 and they have rolls with little omelettes in them so you can put them together and have a bacon and egg roll if you want! I would assume it would be similar at Gatwick.

    been waiting 11 days for points transfer from amex to BAEC. Is tis usual or should they have moved. Amex say transfer was done on day of request. BAEC say they have no request and call Amex. Any help appreciated instead of going round in circles.

      I should add that my middle name, Lucky, hasn’t helped in the slightest this year. I’m also in a group action against Ticketmaster and my data also possibly compromised by a third company.

    i just cancelled my IB a/c and I was impressed that it took a mere 3 hours. I got the following reply:

    “In response to your request for data erasure and pursuant to article 17 of General Data Protection Regulation (GDPR) and to relevant national data protection laws also applicable we are glad to inform you that, in accordance to the terms of your request and in relation to the following Iberia data records:

    – Iberia Plus/Iberia Loyalty Joven Scheme

    , we have erased all data that correspond to the identity information provided along with your request.
    As a consequence Iberia does not hold any personal data it is not legally entitled to retain. However please take into account that Iberia will block and not erase those data which are strictly necessary for Iberia to comply with any persisting legal requirements to do so, as well as for the preparation, exercise and defense –as applicable- of/against claims and legal actions, in general.”

    In other words I don’t think closing your account will make any difference.

      Can’t see how you can draw that conclusion. There wouldn’t be a legal action or claim against you if you now ex-account went to -90K on Dec 2nd.

          IB are pretty good at replying to emails.

          They’ve run a very silly promotion here, and it will be interesting to see how things play out. But I wish they’d just clarify things.

    Mentioned in comments yesterday but perhaps more relevant here – had a phone call from Creation cancelling my IHG card. They told me it was in a list from Mastercard as one that was compromised. Will take a week for new card to arrive. Abroad just now and have other options but pretty annoying.

    I see other legal firm (https://www.badatabreach.com) taking a different view as to culpability!
