Thank you. So writing to BA Legal instead of contacting the Customer Service first should be appropriate course of action? Is there an email address to BA Legal?
You need to go through customer services first.
No you don’t. I never do. It’s straight to the Legal unless it’s a missing Avios claim. The more annoyed Legal is because of this, the better the customer services will get.
Regarding the weather. Yes both airlines and airports have detailed, covering each hour, that forms part of Ops meetings several times a day.
The evening before weather warnings would’ve been discussed and its impact assessed with data from NATS, Met Office/ X Private Provider, Airports and a myriad of other agencies.
It would be assessed again at midnight, 4/6 am and so on. Whilst it’s not always an exact science those involved will use experience to make calls. If there was an ATC restriction between X & Y times then it may be a priority to land a long haul flight over yours ( as an example). It’s just how it goes when restrictions are applied and BA would know about the potential for them the day before if it’s projected weather.
All that said. Good luck on getting some comp
UPDATE – BA has just responded and confirmed that I am in fact entitled to compensation. This is highly unexpected. Based on the comments above I did accept there would be no compensation due to bad weather at LHR on 13 March. I am not sure how they calculated the £110. It is normally either £220 or nothing. Perhaps £110 is for flights departing early?
“ We’ve reviewed your application and we’re pleased to confirm that you’re entitled to compensation under Air Passenger Rights Regulations. This has been calculated as GBP 110 per customer”..
That’s an extraordinary result – well done. In paying half, BA is relying on Article 7 2(a) so they are paying you for the cancellation/early departure but because the rerouting didn’t make you over 2 hours late, they can reduce the compensation by 50%. Whether that’s strictly correct or not is maybe debatable, but given they might have cited ‘extraordinary circumstances’ might be better to take the compensation rather than attempt to challenge.
