Quick question. My daughter was supposed to be flying MCO-MAN 13/06/23 @ 17.45pm. They got the email yesterday that the flight had been cancelled and they were rebooked on Virgin 13/06/23 @ 21.00pm. Looks like if everything goes according to flight times, they should have landed with Aer Lingus at 07.20am on 14th but will now arrive at 10.05am. She has no idea why its been cancelled so doesn’t know if she’s entitled to any compensation or duty of care….I can’t see why it has been cancelled other than that the MAN-MCO flight in the am was also cancelled, so no plane….

Unless Aer Lingus can cite ‘extraordinary circumstances’ your daughter should be entitled to €600 compensation on the basis of Article 5 1(c)(iii) for a cancellation unless :- “they are informed of the cancellation less than seven days before the scheduled time of departure and are offered re-routing, allowing them to depart no more than one hour before the scheduled time of departure and to reach their final destination less than two hours after the scheduled time of arrival.

In respect of ‘right to care’ she is entitled to:- “meals and refreshments in a reasonable relation to the waiting time” whatever that means, so perhaps for a three hour delay around that time of day, dinner might be considered reasonable, but the airline isn’t really on the hook for all that much cost.

@JDB, she’s not having any luck with Aer Lingus. They aren’t giving her any reason just say it’s outwith their control….they are also suggesting she has to return the hire car at the original 2 hrs before the Aer Lingus flight, so 5+ hrs before her new flight… They have also lost disability allocated aisle seats and a vegetarian meal… drama drama 😂

Whether or not Aer Lingus tells her the reason (which they probably won’t to any reliable degree if at all), that doesn’t affect her entitlement to compensation. However, when EI says “outwith their control” is does rather sound as though they will play the ‘extraordinary circumstances’ card. The airline won’t be responsible for any additional hire car costs if applicable; that’s a matter for insurance but with an excess that may not be worth a claim even if the car hire people allow a late return. Hopefully Virgin might be helpful re the seating, although the flight is likely to be full if they have all the cancelled EI pax.

At least they have been proactively rebooked and dont have to battle with a call centre for an available flight. Not something that I have experienced with BA. Well done Aer Lingus.

Spoke too soon, she’s now telling me her app is saying the Virgin flight is now leaving at midnight for a 19 hour flight….virgin phone agents saying same but can’t tell her where the flight is via….something odd afoot

Aer Lingus have now cancelled their booking on the Virgin 9pm flight saying it is a 19 hour flight (odd) and rebooked them on the Aer Lingus flight +1 day and told them to book a hotel, car etc and reclaim the expenses…are they likely doing this to keep things cheaper for them? Is a hotel night and car hire the best option for Aer Lingus?

Probably best enjoy the extra day at Aer Lingus expense, keep receipts and check for sure booked on the +1 day flight.

I think the most likely explanation for the change is that someone at EI saw there was a disabled passenger on the booking and perhaps realised that sending them home via a connection (which a 19hr flight would appear to be – was there any email saying what the rebooking was as that would confirm) might not necessarily be the best thing to do.

It’s unlikely to be a cost saving issue. Airlines have all sorts of agreements about fares they pay each other when rebooking passengers after cancellations or irrops. Let’s say they would be paying nowhere near the rates we might see when booking a last minute fare.

Hope everyone gets home safe and sound.

The 9pm Virgin looks full so I wonder if they didn’t accept the rebooking. But their later flight VS74 at 10.20pm has plenty of seats if she wanted to try again to get them to rebook

One of their aircraft G-EILA (I think they’ve only 2 G- registered at Manchester) went to Dublin , possibly for maintenance and the other one went to NYC today . Can’t see why that’d be extraordinary circumstances

Thanks guys, no emails re. 19 hour flight and neither virgin nor Aer Lingus could see what the itinerary was, all a bit strange. They accepted the +1 day flight as 3 out of 4 of them had no need to rush back. They have been able to select seats & veg meal on new flight so pretty sure they are on it, if it flies 😂
Guess they will just try a compensation claim when home and hope for the best 🤞
