    I know this topic is discussed to death on here and I apologise for asking but I find the EU261 compensation quite confusing and I know there are many knowledgeable people on here.

    I have just arrived back on the MEX – LHR BA232 in CW. On departure after doors locked and bridge disconnected a passenger said they were unwell. Reconnect to bridge, doc onboard, passenger deplaned, the baggage is located and removed. We then get underway again to the point we were almost about to turn on to the runway and another passenger claimed they were also unwell! We then taxi back to stand, connect bridge, doc on board, this passenger is deplaned, baggage located. We also have to refuel and captain says they need time to do some recalculations paperwork etc. At this point we are approximately 1hr 45 delayed. I also hear idle talk amongst the crew wether the delay would cause them to be over their permitted hours. Fortunately that didn’t appear to be an issue and we eventually departed approx 2hr 35 mins late.

    Of course I have sympathy with anyone who is feeling unwell but I just wondered if in these circumstances any compensation could be claimed? Or can BA state the events it was outside their control?

    As an aside the service was quite poor onboard, my partner wasn’t even offered any breakfast (missed by crew). And when we landed there was another approximately 25 min delay connecting to the terminal because ground crew were in the wrong place!

    For a long haul flight you need to be delayed over 4 hours to be legally due compensation, so No.

    You might get 5,000 Avios if you make a complaint about the other issues, although given that huge numbers of people who arrived over the weekend didn’t get their baggage back at all you may want to consider yourself lucky …..

    I wouldn’t ordinarily comment, however this is the second thread within a week where the question over compensation for delays caused by medical episodes has been raised.I understand that EU261 is there to grant travellers rights, and compensate them when appropriate however I do find even questioning whether you can benefit from compensation because of someones unplanned medical misfortune rather distasteful.

    No chance whatsoever. If you ever had an exceptional circumstance that was outside the control of an airline, this is it.

    If relevant you would have still been eligible for duty of care provisions (extra hotel, meals etc ) if your delay had been a very long one, likely if your flight had been cancelled and not a replacement flight provided soon enough not to need these. Or a considerably longer delay to same flight, if these had been required. These things are either ” provided by airline” or may be sourced by you, and claimed for reimbursement if you make an effort to get airline to provide and airline fails to provide. But that’s a different part of EU261 and reimbursement of what you spent out of pocket, at best.

    You were delayed on departure, but what matters is the arrival time. I presume you also made up some time in the air so it must have been less.

    I understand it may appear distasteful but I wasn’t seeking to ‘profit’. The delay has genuinely caused me to be out of pocket and I wanted to know the legal position.

    Interesting that we don’t get into the kind of moralising for say compensation for train delays, which are paid regardless of reason.

    Good point, people jumping in front of trains and ill passengers causing delays still counts towards ‘delay repay’ on the railway. I’d never thought about that before.

    How late did you arrive on LHR compared to original scheduled arrival time? As arob says you are only allowed compensation if you arrive more than 4 hours later than scheduled.

    Am curious as to how you are out of pocket? You were transported from Mexico back to LHR

    Only consequential costs, I missed onward travel and overstayed parking at final destination.

    I am not particularly too aggrieved, I accept these things happen. I was more curious as the position when a plane is delayed for this reason. I don’t exactly know how airlines manage this kind of risk (delays, cancellations or diversions caused by passenger illness), do they insure against it?

    I forgot to add it landed 2hr 10 mins late + an unnecessary 25-30mins sitting on the ground because of the gate issue so total 2hr 40 or so
