    Hi, my wife and I were booked to return on BA 206, to LHR from MIA on Friday 14 March, departing at local.

    That morning we received a text to say the flight was delayed and would now depart at 2245 local, but we should still check into MIA for the original flight time, and they would issue a food voucher.

    On check in and subsequently BA staff explained the aircraft had gone ‘teck’ and had to be replaced, but there was an issue with the new aircraft.

    We subsequently landed at LHR just under 6 hours later than our original arrival time. On the advice of the CSD I submitted a compensation claim to BA as I think the above is covered by the EU legislation. However, I’ve received an email rejecting this on the grounds they’ve compensated me already and won’t provide anything further.

    I’ve checked my Executive Club account to see if they’ve deposited any Avios as compensation, because other than a meal voucher nothing else was given or received.

    Does this sound right or is the reason there is no compensation because the delay was out of BA control, and therefore one of the permitted exemptions to the regulations?

    Normally, technical issues are not classed as extraordinary circumstances and you would be eligible for compensation.

    It’s unclear here what the issue was with new plane and this could be why your claim was rejected (the previous aircraft going tech wouldn’t automatically entitle you to compo, if the replacement had got you back to LHR on time).

    Push back and take BA to CEDR if need be.
    As NorthernLass notes, technical fault with an aircraft is not an extraordinary circumstance.
    You are also due cash, not avios, as compensation.

    According to Flightaware your flight arrived at LHR T5 on 15 Mar 2025 at 11:57am 5 hours 7 minutes late

    Your flight was delayed because the outbound BA207 flight from LHR was delayed. If you were told it was because the flight had tech issues then you should be entitled to compensation. It was an A380 so sounds reasonable that it was technical issues that caused the delay.

    It’s odd BA state you’ve already been compensated. I wonder if BA has misread your claim and think you were claiming food and drinks.

    Has you case been closed? I would respond to the email stating that you are claiming compensation per EC261 for the delayed arrival of BA206 that departed MIA late on 14 Mar 2025 and arrived at LHR on 15 Mar 5 hours 7 minutes late.

    Remember that each passenger is entitled to compensation so you and your wife should both get £520 each.
