    My son texted me this morning. He was returning from san francisco via new York in first. The flight from new York to Heathrow was cancelled due to technical issues. He’s been put in a shocking hotel and is on a flight home this morning business on jet blu.
    What will he be entitled to? These were expensive tickets booked quite recently.

    Discussed here a lot:
    1. For the cancelation, if he ends up getting home (last stop) late he will get compensation (~£500)
    2. For the downgrade he is due 75% of the price paid for that specific leg. (Taxes are the same so you don’t get that but refunded)
    3. Obviously hotel, transport, food, etc. should be reimbursed. Keep all invoices.

    True. You need to be flying a EU/UK airline. I supposed you are not flying first with AA.

    According to BA flight status there were two JFK-LHR flights cancelled last night.

    The 19.30 – BA176 and the 23.00 BA1515 (which is an AA operated flight)

    If it was the former the there were several other flights he could have been rebooked onto last night but if the latter there were no other flights until this morning.

    So as AA appears to be the operating carrier then UK261 rights don’t apply.

    He will need to contact AA about this as he will be under their policies.

    I’m not sure why they put him in Jet Blue as there are two AM flights to LHR this morning one operated by BA and the other by AA.

    I think it is wrong that you can have a BA ticket but not BA ie UK protection. Buts that’s the rule.

    As it was a cancellation, I’m not sure why they couldn’t move him to a OW J/F departure the following day. NYC isn’t exactly short of BA/AA services.

    The legislation says it’s the operator that’s responsible rather than the issuer of the ticket which makes sense, although there are circumstances where the ticket issuing airline can be held responsible. There’s a further element of principle against any extraterritoriality in legislation, so UK or EC law can’t be imposed on third country carriers departing from a third country.

    US airlines have however, been unsuccessful in challenging the fact US domestic flights, as part of a through journey originating in the UK or EU, can be covered by 261.

    If two evening OW flights were cancelled including a premium cabin heavy BA flight, it’s going to be very difficult to re-accommodate them all on the two morning OW flights, so Virgin or JetBlue are a necessary ‘overflow’ if BA/AA don’t have capacity, or the pax has to wait until the next evening subject to sufficient availability, which may or may not suit everyone.
