We had a flight from LAS to LHR diverted via JFK the other week because of a medical emergency which resulted in a 5.5 hour delay. Does anyone know if there’s been any cases of this type to support a successful EC261 claim?
I recall one from a few years ago via flyer talk where someone took this to MCOL.
Was rejected as it was clearly an exceptional circumstance beyond the airlines control.
Extraordinary circumstance so no compensation. Duty of care still applies, so if it caused you to overnight at Heathrow or if the flight arrived so late there was no public transport and you had to take a taxi, you can claim that.
Absolutely no compensation. You couldn’t get a clearer case of exceptional circumstance that the airline could not have avoided. So no compensation.
Full duty of care though. For any extra time the journey took, hotel accommodation (at local rates when needed) amd all meals at local reasonable cost (avoid alcohol, caviar etc.as those won’t be reimbursed) at the normal times occurring during your extended travel time, are the responsibity of the operating airline whose flight delay etc. caused the extra jouney time. You can also claim internet or 2 phone calls.
