Forums Other Flight changes and cancellations help Internal US flight booked with Avios cancellation

  • 26 posts

I have a flight from Miami to Key West booked with Avios and BA has just emailed me saying that it has been cancelled. I would like to move to an earlier flight but BA says they can’t move me to it because there are no T class tickets on this fight. AA is selling Y cash tickets for this flight. The reason they are giving me is that EC261 cannot be applied because is an internal flight. Is this correct?

    Thank you

Yes that’s 100% correct. This is not covered by UK/EU261 as it’s a flight operated by a non EU airline in a non EU country.

Just because you booked this via BA does not change that.

The only way I can see BA being responsible for this is if your single journey is departing in Europe or UK on any airline then continuing to Key West with less than 24hrs layover at the connection point.

In that case it’s all covered from origin to Key West destination even through connection(s) and even if the MIA-Key West is on an airline that does not come under EU261/UK 261. In that case your EU261 or UK261 rights cover you all the way to Key West. This point has been clarified clearly by case law.

If this is your case go back to BA, mention the above and request they reroute you through to Key West by any means necessary including different routing if necessary. They are responsible for this.

    Let us know the outcome.

And just to be very specific, if the above is your situation then it’s completely irrelevant that there are no T class/award/any other particular booking class seats, on any suitable replacement flight on any airline to replace any part of your journey to Key West. You are entitled to any seat available in same cabin as you booked no matter what its booking class on any airline that will get you there.

    Thank you very much!
