Forums Other Flight changes and cancellations help Norse experience for re-booking?

    Morning all, anyone had any experience getting Norse to rebook them on another carrier, or more likely, claiming back the fare?
    Norse have moved our Miami outbound a day earlier in November, and just wondering how long or hard I may be fighting for rerouteing refund, presuming they won’t book it for me (of course, they might??), before I book on to BA or Virgin with my own money…

    My guess is they could be gone before you obtained a judgement against them.

    As above, by the time you get a judgment and apply for enforcement it may be too late and if they ignore your claim such that you obtain a default judgment, it’s all a bit harder.

    If they decided to defend your claim, they would probably say they have complied with Article 8(1)(b) by rebooking you the day before = “earliest opportunity” and that it isn’t open to the passenger to pick and choose which flight he takes and your decision to book something else was voluntary. You can point to a different view in CAA guidance, to which they will say, that is precisely what it says – guidance, not law.

    If you do decide to book/reroute yourself, make sure it is very strictly under “comparable transport conditions” and that you keep evidence that the fare you paid was comparable and fair.

    You will need to prove to the court that the self-rerouting expenses were “necessary, appropriate and reasonable” so also keep a good record of Norse refusing you rerouting.

    There’s much talk of people doing this sort of thing, but you need to be aware that it’s not always as simple as all that and there are risks involved.
