Minded to complain to the CMA as it hardly appears optional in these circumstances.
Be more effective to tell the hotel you will refer it to the credit card company. You’ll get a swift monetary resolution, rather than at best from the CMA a toothless response after two years of pencil chewing.
Also, the OP may not have noticed that the head of the CMA was sacked by the government so they could be replaced by someone more business friendly. Same process is happening at the FOS where chairman sacked and CEO/Chief Ombudsman has left to spend more time with her family. They have been largely and deliberately defanged.
In any event, before complaining to anyone, check that you weren’t actually correctly notified of the service charge. Lots of complaints mentioned here on various topics claiming things weren’t in the terms, not notified in advance etc. which was very quickly proved to be incorrect.
