Hi, trying to rebook some cancelled flights with BA (on Avios) and getting told the usual, that can’t book beyond ticket validity, ticket has expired so best we can do is a refund. I cite my UK261 rights to no avail, and naturally they are keen to refund (which I made clear I do not want).
A previous Letter Before Action worked and they rebooked the flights for a different booking. I’ve tried contacting legal with the Letter Before Action again, but they still refuse to budge.
The flights I’d be rebooking are on BA itself so it seems like a big waste of court fees and hearing fees if it gets to that stage.
I’m happy to do it, but other than the legal department, is there any other way to escalate this? Maybe email the CEO as they usually have a team that deals with these sort of things? Just wondering if any other way to make them see sense before left with no option to go down the MCOL route. Clearly also helps to demonstrate to MCOL that you tried everything before this stage.
Thanks in advance.
If legal told you no, there is literary nothing that demonstrates more that you tried. Personally, I wouldn’t bother contacting anyone else. I’d wack the statutory interest and MCOL fees and any extra costs such as postage fees.
Thanks, Yes the position is that their conditions of carriage supersede article 8(c) therefore the ticket is invalid. Seems like a straightforward case at MCOL, but just crazy that have to go through this again to get a flight rebooked (on BA itself).
