As above I’ve just seen the sign up offer of 60k avios with 5k spend in 3 months for this card ( via the ba exec account home page ) Annoyingly I signed up last week for the same card on the standard 25k avios for 3k spend in 3 months . Any idea if it’s possible to get the higher bonus some way ? I’m assuming I can’t cancel and re apply as I won’t be a ” new card member ”

I seem to recall someone doing this but being told that even though they were within the cooling off period, it still counted as holding a card and would reset the 24 months. I wouldn’t rely on what a single chat agent says about anything Amex-related!

The cooling off period allows you to withdraw from/cancel the contract for 14 days after receiving the card, but this does not have the effect of cancelling your successful application that triggers the SUB eligibility.
If what the chat agent said were true, the XMS players would have been laughing with SUBs every two weeks or so until Amex got bored.

Whatever you get recorded, chat agents cannot bind the organisation to random terms and conditions and staff are allowed to make mistakes. You have said it’s “too good to be true” yet you are now going to make a conscious effort to catch them out. Seriously?
Any complaint you subsequently made would be considered as a customer service issue rather than anything else; you would need much more than ‘chat’ to establish estoppel and where you may end up is no SUB at all as the 25k is clawed back and just some small bung for the customer service error.
There’s also of course the possibility that your new application gets rejected!

Is the above link a referral link as when I go on the Amex page generally there is no enhanced bonus on any of the BA cards . I checked via BA website too any it’s the Shane welcome bonus
I’ve clicked on the link and it does she it’s enhanced however is that a referral link or as it seems strange why the enchanted bonus isn’t being shown on the main Amex page for anyone to just look (ie going via Google)
You can only see it via the My Account page of BA.com (bottom left).

I’ve seen you say this and similar before, and it doesn’t quite ring true to me. If a financial services company (via one of its representatives) tells me something that I rely on when making a decision about its products, and subsequently says “only joking!”, I’d be expecting a win at the FOS without too much debate.
Are you seriously saying that financial services companies can tell you whatever they feel like, and not stick to it? That doesn’t seem like the sort of environment any sane government would want to encourage. If the company wants to avoid standing behind things they don’t agree with then they need to train their agents appropriately.

Asking chat is the way, that’s not too complicated so they’re normally correct and if they’re wrong you’ve got it written down to challenge them on it.

I would expect that if someone representing and acting as an agent for a credit card company tells the consumer he will get a feature or benefit should he cancel and reapply, and then the consumer does not, that it is mis-selling, and in fact putting the consumer in a worse position had he not spoken with the agent, as he will not be getting ANY sign-up bonus.

These cases of reliance upon dodgy info from Amex agents have been extensively reported here and unsuccessfully challenged. In essence, people and organisations are allowed to make mistakes and contracts can be voided under common law for mistake. If everyone were held to their mistakes there would be complete chaos! This also cannot be a case of mis-selling because no advice or selling is involved and you have to acknowledge that expressly during the application process.
The FOS will not hold Amex to a SUB based on mistake, but treats the matter as an inconvenience, as Amex will have done in the complaints process, such that some sort of payment will be made for the erroneous information. Companies and regulators afford the most enormous protections and opportunities for redress to us in this country, but customers are also expected to play their part and accept some responsibility for their actions. If churners really can’t keep a record of when they cancelled a card, they are in the wrong game.

Amex is selling the customer access to a credit card in return for a non-refundable £250 per year. If an agent of amex has stated (and it can be proved via a chat history etc) that the cancel/reapply as above makes the customer for eligible for the new bonus which “is more than enough for return flights to hit the dunes of Dubai or the rooftop bars of New York”, and then it transpires Amex denies the bonus, then I assume most reasonble people would conclude that not getting that benefit for something that was sold is somewhat more than an inconvenience.

In my notes I’ve got Dec 23 as my 2 years but the agent has said February 21 I cancelled it which surely isn’t right. That’s why I was asking as it makes me eligible now.
