They will be heard separately if you submit the claim separately at MCOL. Two different individuals. I have done this a few times. BA settled as soon as hearing approaches as they would be running double legal costs. I now make a point of it in my LBAs.
And if you get different outcomes which is far from impossible in some cases reported here, albeit this one looks very solid??
Yes, you could get different outcomes theoretically. Let’s face it BA will very likely not want to pay for double the billing hours and will cave in before the hearing, but you never know.
OP would still be winner even if they only get half the money. You don’t have to actually buy the tickets either.
