In the event of divorce or seperation, can Amex points be shared equally between both parties? Would it entail one party getting a new card eg a free Amex one and getting points transferred over, leaving the other party with the original card and half of the points?
Anyone come across this situation before?

I don’t think Amex points can be transferred between cardholders, though you can possibly do it indirectly by converting them to hotel or airline points.
It might also come down to whether it’s an amicable split – loyalty points don’t legally have any monetary value in the UK so it might be a bit of a grey area for a judge to make a decision on such a thing!

You cannot share Amex points, period. Both parties could agree to send all the points to Finnair Avios and/or Marriott and divide in half from there (assuming it could be done within those scheme rules, do not delay in creating your Finnair accounts!).
I think Rob had experience of a case where one party claimed the cash-purchase value of half the points in one scheme or another, probably BA Avios. My thought is that’s probably the least efficient way of “dividing” the value imaginable.

@byronlewis – you can make provision for how the points are to shared or retained within any financial settlement (agreed) between the parties, hopefully within a consent order. It’s something that crops up more nowadays and hopefully easier than agreeing pensions, debts, housing etc.
In the event of an amicable split, the 2 parties might agree to split the points due to them having been earned by joint spend, for example. So transferring to a hotel or airline scheme would be a way of doing this.
We might need more info from the OP though, as is often the case these things depend of individual circumstances!

Upon divorce, in reaching the separate financial settlement, a court has wide powers to redistribute assets/debts as it sees fit under s25 of MCA1973. The points belonging to one party or the other aren’t really different to a savings account held by one party; it’s all part of the process although it is very fact specific as to what belongs to who and what is marital.
One can’t give any advice on this but get a barrister rather than a solicitor to sort it out!
