😁 Of course it will be sorted, and relevant compensation paid (taking into account you know the Avios hasn’t been collected) . But quite possibly not before the flight has taken off!
Most companies record all calls and auto-scribe them, so the call won’t be disputed. Doesn’t help you at check-in 😔 I guess you may need to call and ask the back office to take the Avios
The call recording is precisely the problem! It will make it quite clear that the passenger was fully aware of the problem and was still trying to evade payment. The erroneous failure of any company to take payment doesn’t change the legal position and you have correctly mentioned that this is a matter of contract and here there are two parties and the passenger is in breach of contract. In this instance, by the time of check-in the passenger is just as culpable as the airline so the idea that the passenger should get compensation for denied boarding is grotesque. Fortunately, on this evidence, they won’t get a penny.

It’s not a problem. The OP will be in the right in that he’s highlighted it and BA haven’t taken the Avios. The problem is by the time it’s sorted the plane will be at 37,000ft. I’m sure the OP is not trying to “game” the mistake, but:
1. BA will recover the Avios
2. In the meantime, your plane is airborneI know there’s only so much you can do, but you have to try as much as if BA had made a mistake.
@lhar – I think you missed the key point. The OP didn’t tell BA they hadn’t taken the Avios. They sniffed around to see if they could get away without paying, but failed to offer to pay or say Avios hadn’t been taken. That’s intent, fully recorded. If they had done anything to alert BA, then the call might have had some defence value and the position changes. I guess that you would also support the burglar suing the householder for getting injured by the broken glass in the window through which they entered. The support for compensation and cheering the deliberate non payment just defies belief. We all need to pay the correct price for our trips.
Hi – ressurecting this thread in the hope there is more/more recent experience of this issue.
I have booked onto a new BA route which launched later this year, tax has been charged to my card, email confirmation of voucher being used, a ‘125’ ticket number is on the receipt and I phoned BA yesterday and asked them to look over my booking for issues and they confirmed all was OK. But no avios has been taken and it has been two weeks now.
I may be very lucky but having experienced a “you have no ticket booked just an itinerary as you were not charged correctly” at a checkin desk and having to run through security once before on an avios booking I am risk averse…
I agree with you. I recently changed an Avios ticket all points and money correctly taken. However was unable to check in. Got to airport to find I didn’t have a new 125 ticket number just the original. (Flights for following day were full and not bookable.) Eventually got reticketed, but with little time to spare as check in was closing. Fortunately I had fast track because there was manual checking of passport and boarding pass at entry to security. Got to gate as it was closing and was last on board so very lucky. But not a good experience. So if anyone wants to ensure they are on their flight without a lot of hassle, I would definitely get things sorted before you get to the airport.
It could also be said that they were being diligent in ensuring that their booking was all okay prior to going to the airport, given the frequency that BA has IT issues 🙂
