Hi all,
Had a cancelled Lhr – Pmi that I recieved 15 days notice
There is earlier flights available but I can’t make them as have train tickets so only
Option is from gatwick or heathrow the next morning
Would I be entitled to a hotel if I changed my flight to the following morning or would this not count as over 14 days or would I be expected to go to Gatwick?
Thanks in advance
The question is whether, following the cancellation, booking a hotel was “necessary” (the word used in Article 9) as opposed to merely more convenient/desirable. The issue with your train tickets wouldn’t be the responsibility of BA, but from what you say are the obstacle to taking the earlier flight offered.
The duty of care from BA has no 14 day window however its always a little more of an issue when it’s from the UK , you’re not on a connected flight and you’re a UK BAEC holder.
However I would be pretty confident that they will stump up for the Hotel and would be claiming for it AFTER the trip.
Infact I have exactly the same thing on the 24th of this month where my Malaga flight on the 23rd was cancelled some while ago and I have swapped to the following morning @ 06:40am and booked a night at the Sofitel. I could not have made the earlier flight on the 23rd so it was the 24th or cancel.
Usual rules apply , you can claim circa £200 for the hotel plus meals at about £25 per person per meal. No booze unfortunately.
