    Hi guys, could use some advice on ym journey today.

    Was meant to be flying BA491 from GIB-LHR. Due to weather conditions, incoming flight was diverted to malaga and we were coached to malaga. Upon reaching malaga airport, they told us the original flight has left tand they will re route us.

    Initially, on mmb and at the check in desk, it said our flight is cancelled and only option for refund.

    We rebooked ourselves on easyjet to get to London.

    After a few hours, we got an email saying they have rebooked us for tomorrow’s flight which would be too late. Our daughter has appointments at gosh.

    My query is, will there be any compensation? I understand the initial flight was cancelled due to weather conditions however, the second flight left without ALL of us (I imagine to keep their timings for).

    This is really poor from BA when AGP is about the easiest airport to get back to the U.K. from!

    BA will probably cite weather which may well cover them in terms of compensation.

    Was there no other BA flight from AGP – BA should have tried to accommodate you on one of their flights or even on IB via Madrid in the first instance, not just offer you a refund. Did you make a note of who told you this?

    Which cost more, the original tickets or the easyJet replacements? I think you’re going to be eligible either for a refund or to claim the cost of the new tickets back (plus any expenses for meals you incurred because of the disruption). You’re going to have to make it very clear that you weren’t informed of your full rights by the ground staff at Malaga, and that you were told your only option was a refund (when in actual fact they should have re-routed you on the same day).

    Include details of your daughter’s medical appointment and emphasise that you had to fly home on the original date, so re-routing you the next day wasn’t acceptable.

    Do you still have the message that your only option was a refund, because you might also have to show that you hadn’t been offered re-routing in MMB?

    Tbh we book BA thinking they’ll be better than others such as easyjet but from recent experience, going cheaper turns out to be less complicated in these instances.

    Unfortunately didn’t think of getting a screenshot of the mmb but I do have a recording of the phone call with BA stating there is no options currently.

    And I also have a screenshot of the BA app saying both gib – LHR and agp – LHR being cancelled separately.

    There was an ago-lgw flight but it went to premium passangers and those with status until it was full.

    I’m not sure which cost more as the BA flight was part of a return flight. Gib – LHR is the outbound. I still have the return to catch.

    Can I not claim eu261 for the agp-LHR as I have it showing as cancelled (despite it actually taking off)?

    With EU/UK261, the reason for the cancellation is crucial, so you can try claiming but expect some pushback from BA if weather caused the situation. High winds in Gib causing diversions to Malaga are a known issue so it’s always advisable to build in some wiggle room if you have to be somewhere on a specific date.

    It might be worth looking at involuntary denied boarding, given that the plane deliberately departed without the passengers, however I have no idea whether this would be successful!

    All that said, there’s nothing to stop you submitting whatever claims you want to BA and seeing what their response is.

    Btw, I hope your daughter got to her appointment without any further stress.

    BA are still refusing to pay out although did pay for our cabs as we ended in at Gatwick and not Heathrow.

    It’s annoying at BA2643 AGP-LGW did depart that afternoon without any problems but BA will never fess up to it.

    Can I take this to the CAA or a mediator?

    Does BA routinely send a coach to collect passengers from GIB and not wait for it to arrive at AGP before letting the plane leave?

    The coach part yes, the leaving without it’s passengers I am not sure. During winter, there are usually 2x BA flights and 2x Easyjet flights from Gibraltar. I know for a fact that the Easyjet flights waited for their passengers as on both of them I had family and friends who were accommodated in a timely fashion.

    Just as an update, BA are still refusing stating GIB-LHR BA491 was cancelled due to weather – I have sent them a picture of my boarding passes showing BA491 AGP-LHR and explained I will raise it to CEDR if not – apparently it costs them cerca £600 per case that is opened through CEDR so hoping that’s enough incentive to just pay out and not be their usual annoying selves.
